I'm no lawyer nor any educated in legal side of things, but I don't think it's actually illegal to post RapidShare links to trial exams (similar to all those torrent sites - none of them actually HOST any copyright protected files). In fact, he should've removed the attachments instead as they're hosted on VN.

actively sharing copyrighted work... that's like actively finding wild marijuana and sharing it with people. It is definitely not legal, but the fact of the matter comes down to who is tight enough to give a damn.

Actually, people have been convicted of "authorising copyright infringement" by simply posting up links to sites where you could illegally download material.
As for torrent sites, I know Kazaa isn't exactly the same but they've been sued before (and lost).
So VN is screwed either way :P but no legal threats that I know of as yet. Not actually sure why they've been removed =\
Disclaimer: I haven't done copyright law yet but I've sat in on all the lectures this semester

In one last rebellion against this power-hungry dicatator, he uploaded an exam pack.
Excalibur became furious and deactivated his account.
But before she did, she told him that she knew his IP address!!!
daniel knew he had to leave town, so he packed his bags, took his trial exams and left home.
daniels probably hiding away in a deserted motel, not knowing that excalibur has a team of assassins hunting him down

First off, we do not have access to remove accounts.
Secondly, they have been temporarily removed while we assess whether we should keep them. You may find that they'll be back.

Power abuse? It's outlined in the code of conduct that this kind of behaviour isn't allowed. It's perfectly within his power to do so. Most of the mods just turn a blind eye to it, and what he's done is what should happen ideally. I mean, we HAVE had companies contact us before regarding these matters and its in the interests of everyone on this website that we don't get shut down for something along these lines.

I don't get what your point is. There's really no correlation between the two. Besides, all of the global mods aren't in VCE, and we do dedicate some of our own time (and not just because we have 'nothing better to do') into moderating this website and making sure it actually runs, so a little respect on your part would be good.

If one actually looked, 90% of links/dl's, exams etc ARE NOT removed, however they still take to take a stance every now and then, Exalibur was merely doing his job, also, as Shinny said it is in the Code of Conduct, but lol @ James207.

He didn't have to remove anything. Wasn't this site made to help people? He could've just let it slide just like all the other helpful exams/textbooks/resources but instead he went out of his way to get rid of a further textbook and various other exams. Just like he went out of his way to bag a little kid a few months back just cause he can. Excal is clearly a cyber bully in denial, dishing out the punches behind the safety of his computer screen ;)

I guess this kinda stops any leechers if he doesn't want them. Or, he might be doing it because some schools use commercial trial exams as SACs, so he will put them away for this period of time.
There's also been an influx of people who just sign up to say "ne1 got [Company] 2009. i desperatly need it"

I fully expect this post to be removed, because as a moderator I probably shouldn't be saying this. Though, admin, I'll happily give up my moderator privileges if it means I can exercise my freedom of speech.
But anyway.
I don't (want to?) believe that the law is so harsh as to punish high school and university students for attempting to create a more even playing ground. The copyright laws were enacted primarily to protect the rights of the creators of intellectual property to full credit for their work. The majority of copyright infringement cases deal with people obtaining commercial rewards from the work of other people.
Practice exams are bought by schools, not students. Putting them up on VN for students to download will not change that fact. Prosperous schools will continue to purchase trial exams by the bucket-load and students in poorer schools will continue to miss out.
As far as I know, nobody is gaining any financial benefit from these exams being uploaded here.
Being a scholarship student who would otherwise never have been able to afford to attend the school I did, I'm aware of how lucky I was to have access to such a wide range of valuable resources. And of how arbitrary and fickle the barrier is between students with access, and students without.
In a perfect world, parental wealth would never be the determinant of the amount of resources we have access to. Unfortunately, this isn't a perfect world. But sharing of exams fills in some of the cracks.
There is following the rules, and then there is following what you truly believe to be right and wrong.
That said:
- The main thing I've learned from 2 years at law school is that the law is not necessarily synonymous with justice.
- Excalibur was perfectly within his rights and powers to do what he did.
- I agree with everything shinny said.

I graduated from VCE 2 years ago, but I choose to remain here and impart whatever experience-based advice I can. It doesn't mean I have nothing better to do, thanks.

Simple really. His detachment from the VCE, as his already graduated, allows him to fulfill the selfish act of removing exams. Just because there no longer useful for him, he takes the assistance away from others. Power abuse. Dog act.
BTW. Out of curiousity, did you consider your last, long post to be some sort of huge rebellious rant (as this leads me to believe:)

I would have thought keeping me on as a moderator would imply an acceptance/endorsement of my stance.
But if the "theatrics" upset you so much (rather than my actual arguments), then that is a problem you have with me, and thus should be kept to PMs rather than drawing this even further off topic.

The official stance is we do not make any legal infringements. There have been many cases in the past where practice exam companies have registered, demanded their materials be taken off the website and threatened legal actions. In this light, what Excalibur is doing is fully within reason. It may not be in the best interest of the students to have the exams become unavailable, but it is the correct thing to do. His actions are not a direct act of sabotage as some are interpreting. Having met most of the moderation team, I can guarantee that every one of us has the moral integrity to make decisions.
This aside, the tone at which some newer members are referring to graduates is absolutely disgusting. Let me remind you that we have no obligation to remain, and anything that we do comes from our good will.
