Post by: mozart on December 24, 2007, 12:51:23 am
hey just curious, see i've started my legal book up 2 chapter 3 right during the holidays and i see alot of the cases and parliamentary acts. Ive memorized most so far but just wondering how many do we have to memorize. i meane there's like an enormous amount of cases and alot alot of acts so which ones do we focus on. Oh yer nd for the acts, do we jus remebr the cases purpose is name and its yr. e.g. Victorian stevedoring & genral company co v digman 1931- the court states the purpose of the division of powers b/w the governing bodies.
do we hve to remember all this: Victorian Stevedoring and General Contracting Company Pty Ltd v Dignan Informant [1931] HCA 34; (1931) 46 CLR 73 (2 November 1931). or jus the name date and purpose.

thnx heaps legal boys/girls

Victorian Stevedoring and General Contracting Company Pty Ltd v Dignan Informant [1931] HCA 34; (1931) 46 CLR 73 (2 November 1931).

You don't have to remember the extended version of cases such as that. A good format is for example. R v. Thomas (1945) or in some cases further on in the text you can just call the case something like "The Franklin Dam Case" (1983).

It is more important to an examiner that you understand the effect of a case rather than all the little coding and such that you have typed up above.

There are a LOT of cases to remember in Legal Studies, you just have to try and realise what is important and what is not. ( Eg. Going Further seections... good for knowledge but now examinable). If you want Unit 3 notes (including cases for relevant topics) PM me your email and I'll send you my notes via MSN. =)

Hope that helps

Dw you are coming up to the above mentioned stuff soon.
That stuff above was being discussed last year.
It comes later in the Constitution chapter and relates to how the High Court can interpret the Constituion and the effect of those cases (eg. Franklin Dam) where the law making powers of the Cwth were extended at the expense of the State governments.
