Can someone please help me with these 2 questions
1) What is the original civil and criminal jurisdiction for the Mag Court?
and
2) What is the role of VCAT?

Mag Court original civil jurisdiction: matters up to $100,000 (matters under $10,000 are referred to arbitration)
Mag Court original crim jurisdiction: all summary offences, indictable offences heard summarily, committals, bail applications, warrants etc

VCAT role: provide a cheaper, quicker alternative to court litigation for minor civil matters - with legally enforceable decisions - 3 divs (civil, administrative and human rights)
Look to the reasons for existence of tribunals

The original jurisdiction for the Magistrates Court includes -

VCAT plays a role similar to a court, but for small disputes, it offers a cheap and less formal method of resolving civil disputes, composing of 3 divisions. Unlike the Court System, VCAT is much faster, legal representation is not required, there are no pre-trial procedures, and it is much more affordable to those seeking small claims. In all, VCAT functions to take the strain off the court system by dealing with minor disputes that if they were run through the Courts, would be a waste of time and tax payers money.

  • Civil - Claims ranging from $10,000 - $100,000. Below $10,000 goes straight to arbitration.
