VCAT

For a question asking to describe the role of VCAT, would this answer be good enough to get full marks?

The role of the Victorian Civil and Administrative Tribunal is to exist as the umbrella organisation, in which various tribunals or lists are listed under. It has three divisions; a Civil division, an Administrative division and a Human Rights division. An example of a list under VCAT is the Residential Tenancies list, which deals with disputes between a tenant and a landowner.

I'd say it amalgamates victoria's various tribunals and is cost-effective, more timely, less formal and has a wider jurisdiction for simple civil cases than courts but I guess it depends on the marks!! I never learnt examples though

Although you are not required to provide an example, by putting in a line about the Residential Tenancies List or the Civil Claims List or another list, your marks can onyl get better. But it really depends on time if you do it.

To be honest, no. You haven't said what VCAT does really. You need to mention that it is an informal preceding in which mediation occurs to resolve the disputes of others. What you've said is right and I would include it but I don't think you have explained the role of VCAT.

Going on from andy, I've found it good to mention their role in the definition, that is:timely resolution, accessible, affordable and informal dispute resolution

No....

VCAT's role is to provide a cheaper, more time effective and informal avenue for dispute resolution.

Mediation isn't the only form of dispute resolution which VCAT uses, as it uses arbitration as well. But apart from that i agree.

Is this better?

The role of the Victorian Civil and Administrative Tribunal is to provide for an alternative avenue for dispute resolution outside the court system that is cost and time effective, as well as less formal. It amalgamates all the tribunals and lists in Victoria under one umbrella, and is divided into the Civil division, the Administrative division and the Human Rights Division. An example of a list under VCAT is the Residential Tenancies list, which deals with disputes between a tenant and a landowner.

It really depends on the type of question they ask, and honestly in most cases your first sentence is enough. The reason I would avoid stating the rest, is because its likely the question will be asking you to compare VCAT to the courts, or perhaps the advantages and disadvantages of VCAT AS WELL as the role. So I would usually see these as 5 markers; Role [your first sentence]. then STR x2 and Weakness x2.

Yeah your'e probably right. Th only time I would need the whole lot would be if it simply asked me to describe VCAT's role.
