Legal SAC Help!?!
« on: June 06, 2012, 06:34:28 pm »

I was just wondering if somebody could give me some advice or help for the upcoming Legal Studies SAC on Courts and Law-making.
I was away from school for a week so when I came back I had only a few days to study for this. It's on this Friday.

Thanks if you can help out!

Did you find any of these helpful? http://www.atarnotes.com/?p=notes&search=&subject=Legal+Studies&units=MyY0

I'd focus on the operation of the doctrine of precedent and strengths/weaknesses of courts, since those are likely to be the questions worth the most marks. Also, with the "relationship between courts and parliament in law-making", you don't need to match strengths of courts with weaknesses of parliament (or the other way around) for SACS. You only need to know that for the exam.

We didn't have to explain cases here in as much detail as we did for AOS2 (at our school, anyway). Basically, you can just briefly describe the effects of the Mabo case, how Donoghue v Stevenson in the UK was a persuasive precedent during the Grant v Australian Knitting Mills case in Australia, etc.

If you have any specific questions, feel free to ask :) Good luck!

Operation of doctrine of precedent, is that just a general info on precedent?
Stuff like
doctrine of precedent ratio decidendi obiter dictum stare decisis
binding and persuasive precedent
reversing, overrulling, dissapproving and distinguishing?

It depends on how many marks the question's worth. The most marks I've seen for an "Explain the operation of the doctrine of precedent"-type question so far has been 8.

Also, with RODD, make sure you explain a few aspects in detail rather than just listing them.

Some other points you could use include judicial conservatism/judicial activism and the fact that the High Court isn't bound by its own decisions, so common law can be flexible.

No problem :) Yeah, mark allocations can vary sometimes.

Hope you did well!
