Mm, true! I'll be prepared nonetheless :D

How are you guys spending the rest of your time until 3pm tomorrow?
Might study for another 30-45 mins and then go to sleep. Then wake up extra early tomorrow and go over some weak/problem areas. I don't know how people can just not to anything the day/morning before their exam! That makes me feel more stressed because I need the stuff to be fresh in my mind so I generally do light study up until around half an hour/1 hour before the exam haha.

I'm going to exercise tomorrow since I haven't been doing anything physically but tomorrow for me as like you said going over problem areas.

I would be so stoked if it was on that but I predict that it's probably going to be a normal/typical question combined with another area of study.

To be honest i hope its either;

- Parliaments/Courts in law-making
- Adversary system
- How the constitution protects rights

Anything other than that and i'm going to have a long 2 hours.

im putting money on this, come on tom waterhouse.

Q) justice kirby stated that the jury system is outdated and that it wastes the majority of victoria's money paying jurors when they could be replaced by alternatives.

critically evaluate the jury system. in your answer provide two recent reforms or recommendations which may/ or could improve the effectiveness of our legal system. man it will be on jury system.

in 2011 almost 50% of the state didnt even answer a question to do with recent reforms to the jury system. if that is not a give away i dont know what is.

they didnt test it last year, furthermore they have no choice to but test it this year.

if the ten mark question is on the adversary system, i would be so happy, but if it was it will probably ask to compare it with the inquisitorial system

hoping the 10 mark question is on either:
adversary system or
parliament as a law maker or
constitution and protection of rights (although probs wont be because it was last year, but who knows hey)

i will jump out of my seat if its any of these ^^^^^

Woah woah, can we just back up to the implied rights and structural protections for a sec? The sections on which the implied rights and structural protections are based are well and truly entrenched in the Constitution. It is because of this base entrenchment that they are fully enforceable by the HCA, and the Parliament cannot simply abrogate precedent on implied rights and structural protections the way they can legislate over any other normal old precedent. Absolutely don't stress right before the exam - but we can all see the logic in this, can't we...? The difference is the rights/protections themselves are not *expressly* entrenched.
[Update: full for 2018.] I give Legal lectures through CPAP, and am an author for the CPAP 'Legal Fundamentals' textbook and the Legal 3/4 Study Guide.

im not going to speak on the majority of legal teachers, but im assuing our teachers have been telling all of us implied rights are not entrentched within the consistution, if i put this in the exam looking all flash lol, ive got a feeling despite you saying its right, many will say wtf no its not.??

Ha - fair point! I think that saying "the sections on which implied rights and structural protections are based are entrenched within the Constitution" (therefore those protections are fully enforceable by the Court and cannot be abrogated or overriden by Parliament) should be fine, though - really just if you're talking specifically about the entrenchment and enforceability of the rights, as opposed to statutory rights for example. I feel like that's pretty unambiguous.....??

If it's in the constitution, it's entrenched - Parliament can't abrogate it. But really, when you're talking implied rights, stick to the fact that these are rights which are not expressly stated in the Constitution but have been found by the High Court to have been intended by the Founding Fathers, or something along those lines.

I think there may be a question on evaluating the operation of the doctrine of precedent, I definitely think there will be stuff on the jury.
If there is a Bill of Rights question I might just kill myself in the exam room. I feel like if I study the bill of rights stuff it won't be on the exam but if I don't revise it, it will be there.
