do civil pre-trial procedures achieve effective access to the legal system? Its worth 6 marks, can anyone help?  :) :-[

you could argue yes and no, and it would be best to argue both sides
yes because if an out of court settlement is reached then litigants money is saved
yes because if issues are conceded before court, litigants will achieve a shorter trial meaning less money spent due to less court hire etc
no because civil pre trial procedures are complex with all that paperwork and require legal representation which can add a further monetary burden to litigants
no because where there is high animosity between litigants it is unlikely that an out of court settlement will be reached or that issues will be conceded before court, hence time is wasted and money is lost

just a rough answer, you'd need examples to back yourself up
