Question regarding Marketing (Consumer Laws)

Hi,

So in the marketing syllabus there is a dot point "Consumer Laws" with the sub-dotpoints: Misleading and Deceptive advertisement, Price Discrimination, Implied Conditions and Warranties. I was just wondering what kind of questions would require you to talk about these subtopics. If anyone could include a sample question and answer regarding this, it would be super helpful!

Hey there Rikahs,
So for the dot point on consumer laws under influences on marketing; they can ask a variety of questions on these.

Some of the most common ones would be:
  • Identify what consumer laws apply to businesses
  • Define what each sub point is and how it restricts/affects businesses (e.g. implied conditions)
  • Explain why it is important for the marketing function to comply with the consumer protection provisions
  • Recommend ways to comply with laws and ways to manage compliance costs
  • Explain the legal influences that affect marketing decisions - this was in my trial

As you can see, the questions are pretty diverse and thus this dot point can appear across all sections of the exam; multiple choice, short answer, business report and extended response (so make sure you have case studies prepared)

Just one more question, say for the question that was in your trials, would you talk about just the two laws (ACL and CCA) or talk about implied conditions,etc as well?

Hey Rikahs,

In my trial, I talked about statutory obligations i.e. Consumer Laws through the Competition and Consumers Act 2010 (Cth) and the Fair Trading Act (NSW) and the obligations under these acts including the ones mentioned in the syllabus: deceptive and misleading advertising, price discrimination, implied conditions and warranties. Talk about what they are and how they affect business marketing decisions by restricting some strategies/campaigns etc.
