hi, its my first time using this website, my brother uses it alot and says its useful, so yeah, im just checking it out, hope im welcome to :)

Question I have is; Exaplin how the Australian parliamentary system provides for representitative government in the law making process. (4 mark)

My answer;

Being elected by the people, a representivtive government will provide th means to introduce and make laws which apply the needs of the community. A representitive government must also make laws which reflect the moral and ethical values of the community or electorate it has been elected by. For example, if a person is elected by a certain electorate, then he/she must be representative of hearing their needs, such as a need for a change in a alchole consumption law. Hence the elected individual must do his job by entering a bill into parliament regarding the wants of his electorate.

Is that a good answer?

Don't forget to explain what happens if they aren't representative; i.e. they may be called to step down or may have to go to re-election.

Vital part, if you want the full 4 marks.

This part is really necessary, as it is reiterating what you have already said.

Mind you I don't think this should be a 4 mark question, should be less.

I'd also add in that these elections are regular which adds to how the government is able to represent the views of the people...

Comment on the impact of sec109 of the commonweath constitution can have both the commonweath and the states.
my answer; sec109 of the commonweath consititution refers to conflicts between the states and federal government. When their is a dispute on a concurrect power between state and federal parliments such as child walfare, the federal law made always prevails that of the state law.

2.the div of law making powers between the commonwealth and the states can be altered throught the high court interpretation of the constitution. using an example, explain how the high court's interpretation occurs and how this can impact the div of powers.
the division of powers can be greatly affected by the highcourt as it can give power to different governments through its interpretation of the words of the constitution. for example through the franklin dam case, the Tasmanian government challenged the validity of how far the 'external affairs' section of the constitution extended to. The high court interpreted that the federal government had the ability to make external treatys even of vast las to build a vast water dam. this changed the division of powers as the federal government now had the power to protect australian heritage through the international treaty it had signed.

...federal law prevails to the extent of the inconsistency between the two pieces of legislation. Inconsistent parts of the state law shall be repealed.
