Has anyone else done the 09' Insight exam and found it really dodgy?
I might have a misundstanding or something.. So I may aswell clear it up.
Question 2 of MCQ.
The answer is A. But isn't digital data only affected by the Coypright act 2000(Digital agenda)?
Question 3d short answer.
I thought that the Privacy act(1988) only affected government organizations?
First off, I can't help you with Question 2 as I do not have the Insight paper. Please let me know what the question is.As for question 3D, there are two sets of principles in the Privacy Act (Cth) 1998, the Information Privacy Principles (IPPs) and National Privacy Principles (NPPs). Off the top of my head (and a skim read of the Act), the IPPs apply to any 'agency' (s16). Where an agency is:
(a) a Minister; or
(b) a Department; or
(c) a body (whether incorporated or not), or a tribunal, established or appointed for a public purpose by or under a Commonwealth enactment, not being:
(i) an incorporated company, society or association; or
(ii) an organisation that is registered under the Fair Work (Registered Organisations) Act 2009 or a branch of such an organisation; or
(d) a body established or appointed by the Governor‑General, or by a Minister, otherwise than by or under a Commonwealth enactment; or
(e) a person holding or performing the duties of an office established by or under, or an appointment made under, a Commonwealth enactment, other than a person who, by virtue of holding that office, is the Secretary of a Department; or
(f) a person holding or performing the duties of an appointment, being an appointment made by the Governor‑General, or by a Minister, otherwise than under a Commonwealth enactment; or
(g) a federal court; or
(h) the Australian Federal Police; or
(i) an eligible case manager; or
(j) the nominated AGHS company; or
(k) an eligible hearing service provider.
The NPPs seem to apply to any other organisation that is not the above (i.e., the private sector). However, you must remember that the Privacy Act (Cth) 1988 only has jurisdiction in respect to
federal government agencies and 'organisations' (business with a turnover of over $3 million, among other things). The other act is the Information Privacy Act (Vic) 2000, which is relevant to Victorian government and local governments. I'm not sure if you cover that act though.
