Should digital piracy be considered a crime?
Digital piracy can be defined as illegal downloading, copying, producing, sharing and selling digital movies, games, music, videos and software. The reality is that most of us have downloaded something of the net illegally at least once right? It has become so easy and so normal for our generation not to pay for movies, games and music especially. Few if any of us view it as a crime, but it is actually stealing given that manufacturers, game developers, filmmakers and musicians are losing money from people not buying but rather downloading their art. As much as all of us want things for free illegal downloading creates problems for industries and must be stopped. In response to this growing problem, Copyright Infringement has been placed on digital products so that those who illegally download are committing a crime and if caught are prosecuted. It is a serious issue around the world and fines are increasing all the time which means that we can no longer kid ourselves that digital piracy is not a joke but a true crime.
People who download illegally are stealing. There is no way to justify such actions any other way. Illegal downloads mean that the hard work and monetary investment it takes individuals to develop and produce music, games and movies is stolen by digital pirates who are not prepared to pay for the product. Inventing and creating products that entertain us takes endless hours and much money to get the product started, developed and finished. It takes time, dedication, creativity and the specific skills of the creators to develop products which they then cannot sell and make money off given people just take rather than buy their product. Let's say a popular pc game is released onto the market and consumers decided to upload and share it on a website like pirate bay. Now the game can be downloaded by as many people around the world as want it given its accessibility on the internet. Individuals download it for free using programs like uTorrent and most of us don’t even think of the consequences to those industries and individual developers who have invested time and money to produce what we simply STEAL. It has become so normal to download for free what we should be buying that we don’t even think of it as stealing anymore. It has become a natural interaction, given who does not like access to free stuff? But, it is an attitude that must stop.
Consider pirated movies and games and the negative effect this has on the respective industries. Some thieves stoop so low that they do not simply download for personal entertainment, but sell downloaded games and movies to profit from. This means that the industry loses money. Investors lose money, creators and producers, will not be fully rewarded, may lose their jobs in the future and the industries that entertain us may simply withdraw from producing future products because it will not be profitable. If we keep being digital pirates and steal rather than pay for our movies, games, music and apps the respective industries will not be able to generate enough revenue to keep the business operating. In addition lots of people may lose their jobs as well which will increase the unemployment rate and worsen the Australian economy. Kim Williams, the chief executive officer of News Corp Australia has stated that “piracy of movies cost the Australian economy $1.37 million in 2012” and “in the music business 28% internet users globally regularly access unlicensed sites that contain copyrighted music.” I think we can all agree that this is a serious problem. We must start thinking of such downloads as shoplifting and not an action that does not have consequences. We have to understand that such digital piracy is a crime that not only negatively effects the entertainment industries but also ourselves.
Think about how popular among us are the new Apple devices such as iPods, iPads and iPhones on which people can buy their music, movies, and games on iTunes. However, hackers employing a method known as jail breaking are able to allow configurations on such devices for third-party apps to download free games and other software which is restricted to individual users. Even though Apple is not a struggling company, why would it continue to develop new apps if it cannot make money off them? It is not a charitable organization, it is a company whose priority is profits. This is why Australia needs to reconsider how it is dealing with the problem and realise that more needs to be done. What is necessary, according to Attorney-General George Brandis is an “effective legal framework of protection and enforcement of copyright.” He argues that it is fundamental to sustaining today's creative content industry and most importantly will ensure the cultural development of our nation." In other words we must stop being thieves and become consumers who buy digital product so that we can support industries to be innovative and generate more money for the economy. If we don’t we will be responsible for the destruction of many livelihoods.

Ok. So I think we all agree that digital piracy is a crime and something has to be done about it. So, how do we stop digital piracy? While the reality is that it is impossible to stop it, perhaps the only way to try and address the problem in the future is to create more advertising campaigns that show how damaging stealing is for the industries that produce our entertainment and warn that eventually they may curb production. Also fines should be increased dramatically so that people learn that it is considered a serious crime and if people are caught they will send a message to the rest of us that it is not acceptable behaviour.
