Hey everyone,
So on Friday, I sat my P's and it is fair to say that it was my bad luck, but I failed my P's because of my driving teacher.
I made no critical errors, however I had a few things I needed to improve on such as indication and observation of my surroundings. No one is perfect, so fair enough. I was doing comfortably well, no critical errors whatsoever.
I had 5 minutes left of the test, and I made sure that I was as careful as possible. My assessor told me to turn right into a street, which I did, and then she immediately told me to pull over to the curb.
She pulled me over to tell me that I automatically failed because my driving teacher apparently used her hands to indicate me that I had to turn right...
I didn't even notice it and it worst of all, it wasn't even my fault. I clearly heard the assessors instruction and I WAS ACTUALLY GOING TO PASS IF IT WASN'T FOR MY TEACHER.
So now, I have to wait a fucking month for the next test and pay $55 to resit it. At that point I was pissed off at the assessor for failing me and my teacher for making it all happen.
After talking to my friend, I was even more annoyed by the fact that the assessors aren't always that strict. He passed his P's even though he ran a red light. Another friend went over a curb and still passed.
Do you think it is worth complaining to Vicroads for a wrongful claim of failure of my test?

You could always try to make a complaint/give an explanation to Vicroads, but I'm 99% sure that they wouldn't be able to do anything - I doubt they can award you your license retroactively. Best case scenario, they might waive or mitigate the fee for the next test (though this is also pretty unlikely, to be honest).


Or you could get another driving instructor, see my sig :P (though in all honesty, there's not really any point unless you're uncomfortable/unable to do it in your own car and therefore need an instructor's).

Terrible luck :( Talk to your driving instructor about what happened and see if she will offer her services to sit the test again FOR FREE (as in you don't have to pay the driving instructor anything, only pay the vicroads fee).

If she refuses to acknowledge her mistake or won't offer you the chance to sit the test again for free with her, name and shame the driving instructor. This is unacceptable behaviour.

A friend was telling me the other day about how his friend failed his test because it was cold inside the car and the driving instructor turned on the heater. Apparently that counts as the instructor interfering with the test. They complained to the manager and the manager took the assessors point of view. But thats total bullshit. If this person couldnt get away with that then....

That said I remember my driving instructor gave me thumbs up discreetly while we were waiting the assessor to make notes after the first section of the test parked on the side of the road. They really shouldnt give you such signals but yeah. Also another friend said they could feel the instructor tap the break on their side of the dual-operated car to signal to them that they should slow down.

In the end its the assessors word against yours I guess.

EDIT: LOL also, someone I know failed coz their instructor didnt tell them how to do a 3 point turn properly and in essence what they did was a failed U-turn

Everyone makes mistakes. Even driving instructors. Don't be too harsh on her - she's obviously trying to make up for it. You also said yourself that your driving isn't exactly perfect, so you'd probably benefit from the extra lessons.

my cousin's driving assessor let him pass when he went 10km over the speed limit but he said he "felt safe" + my cousin's teacher had connections with the assessor

driving assessors seem like uni exam invigilators - they're so bored during an exam that they cant wait to jump at the slightest/non-existent error :|
