(Assume the legislation passes)

I am studying at ANU and I put in a transfer to Monash Uni which I was offered. (Comm/Law which is what i am studying at ANU now.)

If I defer my degree for a year upon entering Monash in 2016 will I then have to pay deregulated fees?
It a $100,000 question.

If you did not accept an offer by 13 May 2014 (so if you graduated in 2014, that's you) then you will start paying deregulated fees under the government's proposed legislation (both the old and the new versions) in 2016.

Ah sorry, seems to me like I misread your question.

178(2) says that if you were enrolled in a course on 13 May 2014, and at all time since you have either been enrolled in a CSP place or on an approved break, you will not be affected by the changes. 178(5) defines approved break, which includes a deferral.

So bottom line is that I don't believe that you'll be affected.

Thankfully, the government can only count on the support of three cross-benchers (John Madigan, David Leyonhjelm and Bob Day) for deregulation, and it needs at least three more.

If you did not accept an offer by 13 May 2014 (e.g. you graduated in 2014), under the government's bill, you are going to pay deregulated fees starting 2016 in any case. Of course, if you defer, it means you'll have one more year of deregulated fees.

No, Thu Thu. You have been continuously enrolled (or on a break) since the cut-off date (13 May 2014), and so deferral / intermission for one year is not going to affect you (assuming you graduate by 2020).
