See, now you're threatening me. You're trying to extort an apology of some kind. I do not apologise for it. I deemed the content appropriate, and did not regard it as spam. I have since sought the appropriate legal counsel and have been advised that I have nothing to worry about.

The ball is in my court. And I choose to let this conversation stay up as testimony to your own selfish actions. I also choose to let you keep your account despite your attempts to bring legal action against me. I would love to see you leave, however, you are entitled to your freedom of speech and there's something in a famous quote about defending to the death your right to say it, etc.

I have not ignored legislation, and I look forward to explaining (politely, because they have my assumed respect) to ACMA that this situation did not constitute spam.

Thanks for your concern. :D

lol. I'm merely asking you to abide by the legislation in future, which you seem to think you are above. It's not selfish or unreasonable to not want to receive spam mail (especially when you have chosen the option not to...).

'legal counsel'. Do you mean a first year legal student? One who has done a couple of legal subjects?

I've contacted ACMA already providing a 'hypothetical situation' and have receive an interesting informed response, which is why I know where I stand.

but hey, your 'legal counsel' knows that they are talking about, more so than the Authority who deals with it, right....??

If you're talking about Excalibur's response, no, that's not it.

Let's break it down into its bare elements.

I run a VCE Help website. I sent around an e-mail for a not-for-profit organization informing members of an activity targeted at VCE students to help them enhance their VCE learning experience. I'd say that's not spam, I'd say that's fulfilling the service that the website provides.

You surrendered your e-mail to me at signup, and whilst you did tick the 'no announcements' box, this was not an announcement for something happening on VN. This was an endeavour to spread a message for a noble organization (UNYA).

This complaint of yours will not stand up in a legal argument. If you wish to take it that far, that is your own decision and I will not make any attempts to stop you. All I can say is: petty, much?

The petty thing is you letting your personal opinion get in the way of using informed information to help you run the site legally in order to let the site succeed and instead being too stubborn to admit you didn't know the legislation and whilst you thought you were doing the right thing by helping out an organisation you weren't actually abiding by appropriate legislation.


I offer you information and all you do is go on the attack - petty much?

Except that your accounts have a long history of going after me at every available opportunity. It's interesting, I'm just reading through your posts on both accounts, and the pattern is clear.

But regardless of that.

The box you are referring to says

"Receive FORUM announcements and important notifications by e-mail"

This was not a forum announcement. And notification, in this sense, is of or pertaining to the forum. Also, there is no actual "opt-out" checkbox. And that is why your argument fails.

But, in any case, you'll be pleased to know that one of the things planned for the Winter holidays was the production of a privacy policy. It was supposed to be ready by the time the full site launched but there simply was no time, and then uni started. Until then, I hope you see why your complaint will not do anything but garner negative attention for you. Have a good day. I'm done with this loaded 'question'.

god damn tia. Are effin serious? It's only one damn email! Bloody hell, I get like 10 emails a day in spam in my old account and I know it where it comes from. But I don't go whining to the authorities.
