Would this question be on the vcaa Exam?

Explain the impact of s.109 of the Constitution on the division of powers.

or

‘The Taxation Administration Act 2010 (Vic) could be challenged in the High Court’. Explain how Section 109 of the Commonwealth Constitution can affect this law.

or

A legal commentator said ‘juries are integral to the production of a just outcome’. Critically examine this comment, indicating the extent to which you disagree or disagree. Justify your response.

Would I see such questions on the exam, or is this type of stuff out of the 'study design'?

Yup, they could all appear on the exam. number 1 definately could be. Question two is almost exactly the same as one they had last year or the year before and the juries one is simmilar to one we had last year.

ohh really, then how am i suppose to learn thoes things like section 109 and 69 and etc... am i meant to memorise each part of the consitution, or is section.109 a known thing, that i will study later time in the textbook? :)

You should learn just the main bits relating to things like; referendum, inconsistencies and also when referring to examples of Exclusive, Concurrent and Residual powers etc. It's not really necessary to memorise every section in the Constitution - your teacher can give you a good idea of which bits to learn. Section 109 refers to when there is an inconsistency between the Commonwealth and State law, in which case the Commonwealth law overrides the State law. It should become second-nature to you by the time of the exam. It's always good if you can refer to specific sections of the Constitution when answering questions (when applicable); shows you know what you're talking about.

You'll learn it all as the need arises throughout the year. No point in stressing about it now. ;)

You'll know the sections back to front by the end of the year anyway without consciously memorising them. There's probably only about 10 that you need to know.
