Yeah, I have no idea how you evaluate the process of a referendum, i just said that they are hard to pass because of double majority, both houses need to pass it and mistrust in politicians and crap but didnt even realise it said EVALUATE :S...

i did B for 10 marker, and I did one recent change - Koori Court - fairness for cultural barriers
and four recommended changes:
- judge has more active role
- more access to legal aid
- increase use of written evidence and statements in trial
- adopt the 'not proven' verdict

and i gave strengths, weaknesses, and the four elements, you think that will get me full marks for question B?

i found the exam pretty easy but the questions were worded stupidly but i finished just on time.

yeah for question b i only had 2 recent changes and a recommendation, but my teacher said it was more important to evaluate the elements rather than throw in heaps of examples, so it looks like you've covered everything, you should be sweet.
and i agree, the questions were worded really strangely- for the high court question, because it was a victorian act of parliament, dd you say the constitutional challenge would have been heard in the high court or supreme court? because challenges to state constitutions are apparently heard in the supreme court of that state but we didn't really cover that in the course so i assumed it would be the high court

hard, what would you have said for the question that said: pre trial procedures help to speed up a civil dispute, to what extent do you agree. Explain with reference to ONE civil pre trial procedure.

It was worth 6 marks. Threw me. What the hell are you meant to write to cover 6 marks worth!
1. talk about what pre trial procedures are and ONE example of them and say how it helps speed up civil disputes. e.g. writ helps parties know what the other wants so saves time in court. (2-3 marks)
2. then you say whether you agree  that pre trial help speed up civil proceedings and you can chuck in some weaknesses of pre trial and some advantages here. (3marks)

not worth 6marks imo, should be 4

Sorry accidentally wrote 6! It was actually 5, edited the post!
I said the aim of pre-trial procedures and how they help clarify issues and stuff.
And then talked about further and better particulars.


i just went on about how it reduces the time in court by:
- maybe sorted out in a out of court settlement
- sorts out legal issues
- judge points out direction
- every fact is known by each party
EG - Directions Hearing - went on and explained this.

then i went on to negatives saying how it delays the amount of time for a civil dispute to be sorted due to procedures such as the Pleadings due to length of time between exchanges of documents =)

i think thats all i wrote, cant remember (Y)

I had a complete mental blank on the separation of powers!! I wrote residual, exclusive and concurrent...doh! It was judicial, legislative and executive!!! bad bridie

Don't even need legal studies you need a 35 in english for most unis...And a very high enter.
