Death penalty for raping and murdering ONE person? Are you guys serious? I wouldn't give someone the death penalty for raping and murdering 100 people, let alone 1 person.

They deserve the standard punishment that any rapist + murderer gets, which is around 25 years in jail (but varies quite a bit). I don't see why this case should be treated any differently. People are just getting too emotional.

The only way to make amends to this situation is to help the victims family out by giving them financial restoration through a "victims of crime" court (or whatever it's called in India). Also, give free counseling to witnesses, close friends and family of the victim.

Bear in mind, that this is in India. Which means, the longer your sentence the more chances you have to get out through bail or political influence.  Its not like Australia, corruption is prevalent, so justice there, is quite scarce. I think, that the reason a death penalty would be desirable would be because the decision is final. he would be dead. There would be no re-trial, and the guys would get what they deserved.

And, oh. She was gang raped. So its not just one person.

Why waste so much money on them, just outlaw them, that would defs be the maxmimum penalty.

Agreed. They deserve nothing less than that to be honest. Nothing they do will bring her back of course, but this is the best they can do to avoid someone else being victim to the same person/people committing the same act.

And inb4 "second chance".. They don't deserve any second chance.

Slippery slope - legalising murder (with death penalty)...? Just stimulating some ideas here. If we set a precedent that murder is okay in some cases...

It's really not that hard to quantify..., but I believe that being raped once is not as bad as being raped five times, even if the one rape was by a gang of people.

He DOES deserve to die he raped and murdered someone. Can you imagine him doing that to someone in your family? You would definitely want him dead.

Careful. Criminal law should not be about restorative justice (revenge).

According to some new sources, the trial for this case is fast tracked and many other rape cases are getting fast tracked due to the heavy protesting in India. The sources have also said that there has been a 1000 page charge-sheet against the 5 men , but the 6th man is juvenile , therefore there is a different court proceedings for him. Hopefully , the rape victims get justice !

Well, given this is India, I'm not sure if there are any other options that would've been better suited for these men. I highly doubt (happy to be proven wrong) that the government will bother giving any sort of counselling or support to fix the mental issues with these men. Might I also say that I'm yet to hear of any counsellor, treatment or medication known to us that can possibly fix them.

The public would not want them to be released or allowed to roam the streets again. And if given time, as Nisha said, there always is a possibility (albeit small) that they'd be released through political influence, money etc.. So I think this is the correct decision.

Another thing is that it will cost the government funds to maintain and keep these men in jail, which I believe is another factor in the decision as well.

I can totally understand that people's emotions would dictate that death/revenge is what these rapists deserve. Because I feel the same way too.

This is a very sensitive topic.

And, oh. She was gang raped. So its not just one person.

There was one victim of crime, but multiple perpetrators.

Tell me, if each of the 6 men raped and murdered 1 woman each, would you give them a lighter sentence, since it is just "normal rape" instead of "gang rape"?

If anything, I would argue that they deserve 1/6th the punishment, since each of them basically only committed 1/6th of the act of the rape + murder of a person. It's bad enough that they are being given the same penalty for raping and murdering one person together as if they had each individually done it to 6 different victims, so stop being ridiculous and expecting a grossly disproportionate sentence like a death penalty.

Can you imagine him doing that to someone in your family?

Please don't throw this bullshit at me. Yes, I can imagine it. Yes, I would be very upset. But I wouldn't expect you to go on a mass-killing spree on my behalf, just to make my feelings slightly better.

I'm not sure on how to approach any of what you've said to be honest. I'm completely stumped.
