Any one out there having a shot at the Corporate Law optional assignment? How are you finding it? :)

Did it last yr, quite straight forward. Just make sure you identify all the sections of the CA affected AND MAKE SURE YOU USE PROPER HEADINGS to identify the different sections you are talking about.

sXXX - due diligence

  The directors may be liable....

sXXX - insolvency

  The company may be insolvent...


Etc.


I lost all my marks because I treated it too much as a law essay and not as a simple business law assignment.

Is it absolutely necessary to have section number headings? I've just got new paragraphs for each aspect of the questions...

Yeah, that's what i've been doing. Seems a bit tricky to put under section numbers - hope its okay that way!

You definitely definitely need to put in the section of the corp act you used to argue a point. HOWEVER, having section numbers as headings is only one of many many ways to seperate your points of arguments. The main point is to clearly show your seperate points of contention.

Also, dont forget to put in some case law if you can find one relevant to your argument. They are needed to get you up to that H1 score we all desire.

BTW, just a heads up in regards to the exam. Make sure while you are doing this assignment - you make a lot of notes about the different sections of the CA, what they regulate, how it is measured and what case law is relevant to that specific section. You want to have a set of notes that will entirely replace the textbook. This way you will know where everything is, and will mot have to waste valuable time flipping through the textbook.

Trust me when I say you WILL NOT have any time to flip through the book during the exam - you will not finish if you do. I had 136 pages of hand made notes for the exam, made a table of contents for them too - so I literally knew every section and relevant case law off by heart. But even I struggled to finish the exam.

Thanks for the advice sluu001.
Fingers crossed for the assignment...hope mine's okay but I suppose the feedback will be important to learn from. I find corporate law to be the most time consuming sub compared to my other comm ones.
