Connect Education has released suggested solutions to the Legal Studies exam, prepared by our amazing Legal lecturer, Rama Sarma.

These are amazing suggested solutions.
I have one questio though, were strengths and weaknesses essential for the second last question on ref and HC interpretation?

Also i talked about "cultural barriers" instead of a third feature of adversary system for last question in inhibiting  fair and unbiased. Is that ok?

Yeah you had to talk about it for High Court and Referendum.
Also my teacher said you had to talk about the judge, party control, strict rules of evidence and procedure and burden and standard of proof for the last one.

I finished with half an hour to spare, so I spent a lot of time on the last question/refining my answers.

For q13 I wrote an intro, then about all 5 features of the adversary system, I evaluated them in terms of the way they either promote or hinder the establishment of a fair and unbiased trial. I compared two of these features (role of the judge, and the evidence that is heavily relied upon). I included a conclusion. Almost 4 pages. Will this be more than sufficient to get a high mark on this question?

that isnt true for the last one, by that i mean your teacher is incorrect, by no means do you have to speak about the 5 features, however in order to get the 10 you had to at least mention 3, i would personally mention 4. The only reason you would need to mention all 5 is if you do not have sufficient information regarding each feature to have a academic discussion.

For the 10 marker, if you didn't explain fair and unbiased hearing but linked all of your points to how X feature related to it, would you still get 10 marks given you satisfied the rest of the criteria? My answer went role of the judge s+w, inquisitorial judge, rules of evidence and procedure s+w, inquisitorial rules, party control s+w, evaluation. It was three pages long - do you think I'd be able to grab 10?

That is incorrect.


You have talk about TWO specific aspects (Role of the Jude and Evidence Procedure, OR Party Role and Legal Representation ETC) in relation to one of the three facets of an effective legal system
- Fair and Unbiased
- Accessible
- Timely

then compare these two aspects with the Inquisitional system, and how IT fulfils the specific facet of an effective legal system that you have chosen.

if you compare three features, the assesor will only take into account the first two comparisons. they will ignore the other one. you wont lose any marks, dont worry

I don't think so because you had to talk about the effectiveness of one element of an effective legal system and compare two of the features. Even if you wrote all the features you will only get marked for the required number. But let's hope for your sake they are lenient. In saying that you probably would get 6-7 depending on the strength of your answer.
