4 mark question; compare Judicial determination and mediation.

I have been told that in compare questions you're supposed to do similarities and differences, I can think of many differences however only one similarity.. That they both have an independent and impartial third party. Someone help pleaaaaaaaase :)

One similarity is fine. You don't need equal numbers of each.

But, you could also consider the fact that they are both used extensively by courts and VCAT; also, that their use in courts and VCAT can both result in a binding outcome (JD always; mediation 99% of the time).
