Defs wouldn't say the exam was good, I think it was easier than last year though. There were a couple of odd questions, where even once you recognise what area of study the q relates to it'll be hard to get all 4 marks, especially if marked globally. There were some easy marks (identify the errors + criminal appellate jurisdiction of Court of Appeals).

The ten mark was something along the lines of "Victorian Parliament represents the views of all people and all people can access the legal system" - Discuss the extent to which you agree

For me the questions about persuasive precedent and residual powers were worded weirdly and hence really hard to answer.

Defs thought the precedent one was oddly worded!! Which question was the residual powers?

Explain one way residual powers can become concurrent.
I just said referendums and outlined the process.

I think that's basically all the q asked for! I also threw in a reference to specific powers

Agreed, the precedent one was awful, I had no idea how to answer it, I just ended up talking about what is persuasive precedent and relating it to statutory interpretation. For the residual powers one I talked about High Court interpretation just cos thats what came to me in the moment. Didn't have time to check any answers though.

I didn't quite know how the approach the last one.

I was so glad civil pre-trial procedures didn't come up, they were my number one weak spot.

I was surprised there was nothing on the jury, and not much on ADR's (apart from the little reference to conciliation.). The question about the VLRC required me to think a bit, as did the 10 marker - still not 100% what is was asking.

Anyone have a copy of the exam?

So two questions, is writing referral of powers wrong for the residual and concurrent powers questions? Also, would you need to talk about another country in detail for the express rights question, all I said was that some countries have more bills of rights :((

Referral of powers is perfect. Other country won't gain you marks I think.

I don't think referral of powers works...because that means transferring all power to to Commonwealth, not sharing power with them

So really quick, the question asking about if the law was vaild for if the government were to sit in on court proceedings, was I right for discussing the separation of powers or am I totally off topic 😂😂
